How do I register my DBA or “Doing Business As…” name in Delaware?
A fictitious business name, or DBA (short for ‘doing business as’) allows you to legally do business as a particular name at minimal cost, and without having to create an entirely new business entity. You can accept payments, advertise, and otherwise present yourself under that name. In fact, if you present your business under a name other than your proper legal name without proper notification, it may be considered fraud.
Without a Delaware DBA (’Doing Business As Delaware’) or Fictitious name, your Delaware business is required to operate under your personal name or names of your partners. Delaware State law requires that you file the proper paperwork in order to not only operate under another name, but even to open a bank or checking account in a name other then your own!
