How to File a New Jersey DBA

When an individual, company or organization wants to trade using an alternative name (commonly referred to as the fictitious name) other than the current name, the law in most states stipulates that a DBA (Doing Business As) must be filed. Normally, most proprietors file for a DBA to be able to advertise, create contracts, open business accounts or accept payments. Often, DBAs are filed to prevent the competition from using the exact name. Companies benefit from this provision since they can file over one DBA without necessarily having to start separate businesses for those names. The kinds of businesses that benefit most from DBA are sole proprietorships. The following steps will help you successfully file for a DBA in NJ:

1. Research the name and obtain the correct form

Perform a rigorous research pertaining your chosen alternative name. Conduct this research through the Division of Revenue and Enterprise Services. If the name is applicable, go straight to the Trade Mark Electronic Search System (TESS) via the United States Patent &Trademark Office. The TESS system lets you search the USPTO’s database of registered trademarks and pending applications to ascertain that the name you intend to file is available and to prevent trademark queries.

You’ll then need to obtain an application for Registration of Alternative Name form. The form can be downloaded from the County Clerk’s Office where your enterprise is situated or from the New Jersey Division of Revenue.

2. Complete the paperwork appropriately

Filling out the paperwork can be easy, but technicalities will depend on the location and nature of your business. One major hurdle is figuring out the kind of statute to file under. Ensure you have the following pieces of information on hand:

· Current business name

· ID number registered in New Jersey

· Exact date of business incorporation

· Set forth incorporation date

· The fictitious name or alternative name you intend to register

· Reason for filing for the DBA

While filling out the form, read the instructions carefully and each entry must be triple checked before moving to the next step.

3. Submission of the filled out registration

Filing a New Jersey DBA ends with submission of the registration form to the New Jersey Division of Revenue. Because there is no online registration of DBA in New Jersey at the moment, submit the form by fax, regular mail or over-the-counter. During submission of the DBA form in New Jersey, ensure to enclose a check payment addressed to the Secretary of State. Cash payments are outlawed.
