Kentucky law states that sole proprietorships, all limited companies, partners, corporations, business statutory trust and cooperative associations have to file for a DBA for running their business under an assumed name.
Filing a DBA registration is a necessary requirement for opening a bank account with an assumed name.
How To File A Kentucky DBA
The DBA filing starts by finding if another business entity has not registered the name you wanted to use. This is done by searching the Kentucky Secretary of State name that is available for search.
Once the name is decided, the process of filling work is started. The form for filing can be downloaded from the Certificate of Assumed Name.
The requirement for filing DBA is different for the different entities depending upon its type at issue. For Sole proprietorship business, filing needs to be done with the county clerk where the business is headquartered.
Rest of the business entities like partnerships, limited partnerships, statutory trusts or limited cooperative associations need to fill the DBA requirements with the Kentucky Secretary of State and county clerk where the business has its principal office or have its registered agent.
The filing fee is 20 dollars.
The renewal of the DBA filing is done after every five years. A renewal certificate needs to be filed with the Secretary of State six months before the expiry date. The Secretary of State will not send renewal certificates so it is best to renew it before it expires.
Tax Rules
By having a name registered does not change the taxation process.
