File A DBA in Maine
In Maine, it is not required by law to register your DBA (Doing Business As), which is also known by the names of Trade Name, Assumed name and Fictitious name. However, companies that are operating under an assumed name needs to file with the Bureau of Corporations, Elections, and Commissions. Sole proprietorships and general partnerships who are running their business under their assumed name need to file with the municipal clerk where their business has its principal office.
Rules for setting a DBA in Maine
As per Maine law, no business sole proprietor or partnership or any corporation can use the name which has already been registered and is being used by the other business. A businessman needs to search the Maine Department of Secretary of State Database to check for the availability of the name.
To create the name, it is mandatory to take into consideration few things like a name should not contain corporation,” “incorporated” or “limited,” or abbreviation of the same unless the entity is the corporation. Similarly, even if a business is a limited partnership company, it should have the name of a limited partner unless it has the name of a general partner added.
- Name should not be reflective or portray any obscene message.
- Names should not be provocative, promote abuse or unlawful activity.
- The name should not mislead people by falsely claiming it to be associated with any public institution.
- “Passamaquoddy” word should not be used, without authorization from the “Passamaquoddy” tribe, except for “Passamaquoddy Bay”.
Filing the Form
- The rules for filing forms are different for different entities who are filing DBA.
- Sole proprietor needs to provide his name and residence address of the proprietor.
- Partnership Company is required to fill the name of their partners including their addresses, the aim of the partnership agreement and the chosen assumed name.
- Limited partnerships need to fill only the name of the limited partnership, the chosen name, location of the business which is using assumed name.
- The Foreign limited partnership needs to provide the jurisdiction where the partnership was created.
- Corporations must fill their corporate name, their assumed name and the state where they intend to use the assumed name. It is mandatory for the foreign corporate to provide the jurisdiction where it is formed.

By getting the trade name registered does not change the tax rules.
