Maryland law states any domestic entity should by law register its DBA (Doing Business As) or assumed name with the State of Maryland’s Department of Taxation and Assessment. Foreign corporations are also by law can register their assumed name if they wish to run their business in Maryland. As per the Maryland law, no business can adopt a business name that has been already registered.
Rules for Setting A DBA in Maryland
The first step involves searching for the availability of the assumed name in Charter Record Search database. In other words, it needs to be found out if the selected assumed name has not been already registered. If it is already taken and is being in use, the name needs to be changed. In short, by law, a businessman has to select a unique name for registering and using it for his daily business activities.
Maryland also prohibits the use of certain names and phrases, for example, corporation cannot create the names that are misleading or states the purpose which contradicts the purpose stated in their format documents.
A corporation must keep in mind to include a corporate designation like “incorporated”, “corporation,” or “limited”. No assumed name can incorporate a word or phrase which is different to its actual entity, for example, if a business is a “Partnership” entity, it cannot use “incorporated”.

Renewal period
The assumed name remains valid for five years and after that it needs to be renewed. Application for the renewal should be submitted at least six months prior to the expiration date. It is best to renew the assumed name for the next five years. In the case of failure to renew the process, the name will tend to get terminated and in this situation, a new DBA application needs to be filled.
