Nebraska – DBA

How to File a DBA in Nebraska

A business may desire to transact or engage in business activities using a separate name from the current name used by the entity. For this to happen, Nebraska law requires the business to file the new name, normally known as the trade name. This process is called filing for a DBA, a short form of Doing Business As. A classic example is when ’Mac’s Fries LLC’’ wants to do business as ’The Best City Frie’’. then, a DBA must be filed by the proprietor.

Benefits of filing a DBA?

In Nebraska, anyone can do business with a trade name or assumed name without having to file a DBA. However, there are far more advantages of filing for a DBA than staying without. A DBA enables the business owner to create a bank account using the trade name. The owner is also able to receive payments and checks through the trade name and this helps in filing for a federal trademark.

According to Nebraska law, specific names are outlawed. The names prohibited include those that reflect immoral, misleading or outrageous tendencies, names that belittle or wrongfully depict a link to persons either dead or living, national symbols, institutions, or beliefs. A name also falls in the prohibited bracket if it encompasses or mimics the coat of arms, flag or symbol of the U.S., other nations, municipality, any state or contains the name and signature of any individual alive without their express authority.

It is essential that the brand name doesn’t cause confusion with the general public, so names that almost resemble DBA, describe geographical areas, or just a surname will not be entertained. A name that just states “geologist,” or any modification or descriptive of the word will be frowned at. For an individual to have a way with that word, they must get approval from the Nebraska Board of Geologists.

DBA Filing & Registration in Nebraska

A trade name must also be accompanied by a legal notice that must be published in a circulating newspaper. The Secretary of State will provide more technicalities on the requirements of the publication.

Note that filing and acquiring a trade name does not change the modalities of your business taxation policy.
