Vermont – DBA
File A Vermont DBA
In Vermont, any individuals, businesses, and associations that wish to operate their enterprises under a different name or an additional name are highly encouraged to register a trade name. The trade name in this state is the same as ‘doing business as’ name in other states. This trade name, however, should not be confused with a business name. It is simply an additional business name under which a formally registered business would like to identify itself. And the trade name owner can be an individual, several individuals or business entities.
Why File a Trade Name?
-It will give you a distinct identity within the local community in which you operate and ensure they are sufficiently aware of the kind of business that you are in.
-It will make sure that the name that you intend to operate under is protected, and thus no one can be able to make any claim on it as it recognized as yours by law.
-It is a requirement by the local banks that you legally register a trade name for you to open a checking account for any monetary transactions to prevent incidences of fraud.
Important Details to Note Before Filing For a Trade Name
A trade name is simply a different name by which an already legally registered business would like to identify itself.
In this state, individuals are not required to register a trade name if the business they are operating under is registered under a name that is similar to their legal name. That is, for instance, if the name of the business owner is John Doe and the name of their business is John Doe Enterprises.
The trade name’s business name to be registered can not be the same as the legal name of the individual owner that is provided with the registration.
Under the Vermont law, there is no difference between domestic and foreign trade names and so businesses will be required to register a fresh trade name if they intend to operate in Vermont.
Usually, a trade name will not be registered if it closely resembles one that is already existing to avoid confusing would-be consumers of the different entities.
The business name of a trade name that an entity seeks to register can not in any way imply that the trade name is the name of a business entity as opposed to only an additional name that the business seeks to operate under. Thus terms like corporation, limited, company or any other similar words will not be allowed to feature in the trade name.
Once registered, a trade name should be renewed after every five years.
How long is the process of filing a Vermont DBA ?(Trade Name)
An entity has the option of filing an application for a trade name either by mail or online. Online applications usually take less than one business day while filings that are done by mail take at most ten business days. The forms are readily available online. Once registered, a trade name should be renewed after every five years.
